These Terms of Service (the "Terms") govern your use of the BarNoR application (the "App") provided by Clevique ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. App Overview

BarNoR is an iOS application that scans barcodes to retrieve book and product information and saves it to your Notion workspace.

Key Features:

  • Barcode scanning (ISBN support)
  • Automatic book information retrieval (OpenBD API)
  • Automatic saving to Notion database
  • Scan history management
  • Custom package management

2. Eligibility

You may use the App only if you meet the following conditions:

  1. Age: You are 13 years of age or older
  2. Device: iPhone/iPad running iOS 13.4 or later
  3. Notion Account: You have a valid Notion account and Integration Token
  4. Agreement: You agree to these Terms and the Privacy Policy

Use of the App by anyone under 13 years of age is prohibited.

3. License

3.1 Grant of License

We grant you a non-exclusive, non-transferable, revocable, limited license to use the App for personal, non-commercial purposes in accordance with these Terms.

3.2 Prohibited Activities

You may not:

  1. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  2. Modify, adapt, alter, or create derivative works of the App
  3. Redistribute, resell, sublicense, rent, lease, or lend the App
  4. Use the App for any unlawful purpose
  5. Use the App to infringe upon the rights of any third party
  6. Use the App in combination with automated tools, bots, or scraping tools
  7. Circumvent or breach the security of the App

4. Your Responsibilities

4.1 Account Management

  • Notion Integration Token: You are responsible for properly managing your Notion Integration Token
  • Security: You must take appropriate security measures to prevent token leakage and unauthorized use
  • No Third-Party Sharing: You must not share your token with third parties

4.2 Data Accuracy

  • The accuracy of data saved to Notion by the App depends on information obtained from external APIs (OpenBD, National Diet Library)
  • You are responsible for verifying the accuracy of saved data and correcting it as necessary

4.3 Lawful Use

You agree to use the App in accordance with the laws and regulations of Japan and any other applicable jurisdiction.

5. Intellectual Property Rights

5.1 Ownership

All intellectual property rights in the App and all of its content (including but not limited to design, text, graphics, logos, icons, and code) belong to us or our licensors.

5.2 Trademarks

"BarNoR," "Clevique," and their logos are trademarks or registered trademarks of ours. These Terms do not grant you any right to use these trademarks.

6. Third-Party Services

6.1 Notion API

The App uses the Notion API provided by Notion Labs, Inc. Use of the Notion API is subject to Notion's Terms of Service:

6.2 OpenBD API

The App uses the OpenBD API provided by Calil Inc. to retrieve book information.

6.3 Disclaimer

We are not responsible for the availability, accuracy, or reliability of third-party services. Use of third-party services is at your own risk.

7. Privacy

Our handling of your personal information is governed by our Privacy Policy:

Important Points:

  • The App does not send your data to our servers
  • All data is stored encrypted on your device
  • Data transmission to the Notion API is performed using the token you provide

8. Disclaimer

8.1 No Warranty

The App is provided "as is" without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant:

  1. That the App will operate without interruption or error
  2. That defects in the App will be corrected
  3. That the App will meet your requirements
  4. The accuracy, completeness, or reliability of information obtained from external APIs (OpenBD, Notion API)
  5. The results obtained from using the App

8.2 Data Loss

We are not responsible for any loss, corruption, or alteration of data resulting from your use of the App or saving data to Notion. We recommend that you back up important data separately.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  1. Indirect Damages: Loss of profits, loss of data, business interruption, or other indirect, incidental, special, or consequential damages
  2. Third-Party Services: Failures, errors, or service interruptions of third-party services such as Notion API and OpenBD API
  3. Unauthorized Access: Leakage or unauthorized use of your Notion Integration Token
  4. Data Accuracy: Errors or incompleteness of book information obtained from external APIs

Our cumulative liability to you shall not exceed ¥1,000 in any case.

10. App Modifications and Termination

10.1 Right to Modify

We reserve the right to modify, add, or remove features, design, or specifications of the App at any time without prior notice.

10.2 Service Termination

We may terminate the App service in the following cases:

  1. When it becomes difficult to provide the App due to technical or economic reasons
  2. When external API services (Notion, OpenBD) are terminated
  3. When provision of the App becomes impossible due to laws or regulations

In case of service termination, we will notify you in advance to the extent possible, but we are not obligated to do so.

11. Changes to Terms

We may modify these Terms at any time. Modified Terms will take effect when published on the App or our website (https://clevique.app).

By continuing to use the App after modifications, you agree to be bound by the modified Terms.

12. Account Suspension and Usage Restrictions

We may suspend or restrict your use of the App without prior notice in the following cases:

  1. Violation of these Terms
  2. Use of the App for unlawful purposes
  3. Infringement of third-party rights
  4. Conduct that interferes with the operation of the App

Note: Since the App operates locally, we cannot directly suspend your account, but we reserve the right to refuse to provide future updates.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan.

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable.

15. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements, understandings, and representations relating to these Terms.
